Terms and Conditions - Birmingham City Council Study
1. The Promoter
1.1. The promoter is QLINE Consulting Limited of 10 Station Street, Kibworth Beauchamp, Leicester, Leicestershire LE8 0LN.
1.2. QLINE Consulting is a dedicated ticketing, tourism and technology consultancy offering support and services for tourist attractions. QLINE Consulting Limited are working with Birmingham City Council to find out more about how people visit Birmingham, and what they think about a Birmingham wide Attractions Pass.
2. The Competition
2.1. QLINE Consulting Limited is offering a chance to win a £100 Amazon gift card to every respondent who provides a valid email address after taking the Birmingham Attractions Pass Survey.
2.2. The Competition ends at midnight on Sunday 16th October 2022 when the survey closes.
2.3. By participating in the Competition, you accept these Competition Terms and Conditions.
3. Eligibility
3.1. To be eligible to participate in the Competition survey respondents must have completed the applicable Survey before the closing date of midnight on Sunday 16th October 2022;
3.2. have answered all questions marked as required in the Survey;
3.3. have consented to participate in the Competition in the Survey;
3.4. not be an employee or supplier of QLINE Consulting Limited, or a partner or relative of QLINE Consulting Limited employee; and
3.5. only have completed the Survey once.
4. Prize draw and redemption
4.1. QLINE Consulting Limited will choose the winner of the Prize via a random draw, from all valid entries received from Eligible Participants.
4.2. There will be one Winner. QLINE Consulting Limited reserves the right (but is under no obligation) to offer Prizes to more than one Winner.
4.3. The Winner will be selected through a computer based random draw within 7 days of the Survey ending.
4.4. Selection of the Winner is a completely random process over which QLINE Consulting Limited exercises no judgement and no correspondence will be entered into in respect of the Competition.
4.5. Identities of Winners will not be disclosed or published.
4.6. An email will be sent to the Winner asking them to confirm the Prize that they wish to receive and the email address to send it to. To redeem their Prize, Winners must reply to the Email within 7 days of it being sent by QLINE Consulting Limited with the details requested.
4.7. Unless otherwise stated, the Email will be sent to the email address provided in the survey response.
4.8. Successfully redeemed Prizes will be sent to the Winner by email within 30 days of receiving their Redemption Email.
4.9. If the Redemption Email is not received by QLINE Consulting Limited within the stated time, QLINE Consulting Limited reserves the right to revoke the Prize and award it to another Eligible Participant using the random Winner selection process described above. The same redemption process will apply in each instance, until the Prize is successfully redeemed or withdrawn by QLINE Consulting Limited, at their discretion.
4.10. By participating in the Competition and accepting these Competition Terms and Conditions, you consent to QLINE Consulting Limited using your personal information to contact you if you are a Winner.
5. The Prize
5.1. The Winner will be sent a digital £100 Amazon gift card.
5.2. Entry is free and there is no cash alternative for a Prize and all Prizes are subject to availability.
5.3. A Prize is non-transferable.
5.4. QLINE Consulting Limited accepts no responsibility for any costs involved in using a prize, such as delivery, currency conversions or customs charges.
6. Limitation of Liability
Insofar and to the maximum extent as is permitted by law, QLINE Consulting Limited, its agents or distributors will not under any circumstances be responsible or liable to compensate a Competition participant or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Competition except where personal injury or death is caused by the negligence of QLINE Consulting Limited, its agents or distributors or that of their employees. Your statutory rights are not affected.
7. General
7.1. Personal data is held in accordance with current UK Data Protection legislation in force.

7.3. If there is any reason to believe that there has been a breach of these Competition Terms and Conditions, QLINE Consulting Limited may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
7.4. QLINE Consulting Limited reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary in QLINE Consulting Limited’s sole discretion to do so.
7.5. QLINE Consulting Limited reserves the right to update or amend these General Survey Competition Terms and Conditions (as well as any other policies or guidance we issue) from time to time to comply with law or to meet our changing business requirements, without notice to you. By continuing to participate in the Competition, you agree to be bound by the terms of these updates and amendments.
7.6. If QLINE Consulting Limited deems an individual has acted in bad faith with respect to the Competition, the individual will be excluded from the Competition and consequently be ineligible to claim the benefits of any Prize.
7.7. If any of these Competition Terms and Conditions are found to be illegal, invalid, or unenforceable by any court of competent jurisdiction, the remainder of the Competition T&Cs remain in full force and effect.
7.8. Only you and we are entitled to enforce these Competition Terms and Conditions. No third party is entitled to enforce any of the Competition Terms and Conditions, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 (which is expressly excluded) or otherwise.
7.9. We may freely transfer or assign any part of our rights or delegate our obligations under these Competition Terms and Conditions. You are not entitled to transfer or assign, by operation of law or otherwise, any part of your rights or delegate your obligations under these Competition Terms and Conditions without our prior written consent.
7.10. These Competition Terms and Conditions set out the entire agreement between you and us in respect of the Competition and replace all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law as relate to the Competition. Any delay or failure by us to exercise any right we may have under these Competition Terms and Conditions does not constitute a waiver by us of that right.
7.11. These Competition Terms and Conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
